When you or a loved one has sustained a serious personal injury, an experienced lawyer is required. The American health care system is complicated and the medical bills after a serious injury can seem insurmountable.

If you or a loved one has sustained a serious personal injury, we encourage you to give us a call at 512-478-2211. The assistance of experienced counsel can be essential in settling your claims.

We Handle A Wide Range Of Accident Claims

Personal injury claims can arise from all types of accidents, including those involving:

Auto defects: Automobiles have more safety features than ever. However, seatbelts, airbags and other devices can fail, leaving victims vulnerable in an accident. If you or a loved one has been hurt due to an auto defect, we can help you pursue the compensation you deserve.

Boating accidents

Dangerous premises: Property owners have a duty to ensure that their buildings and land are free from hazardous conditions. Whether you have been hurt in a slip-and-fall in a place of business or have suffered an assault due to inadequate lighting, we can help you hold the negligent parties accountable.

Serious injuries: Catastrophic injuries, such as traumatic brain injuries and spinal cord injuries, electrocutions, and loss of limbs.  We will help you pursue the compensation you need now and into the future.

Medical malpractice and nursing home abuse:  Everyday patients entrust physicians, hospitals, nursing homes and other healthcare providers when they need it most.  When a physician or nurse is negligent, we have the medical experts and resources to make sure they are held accountable.   Types of nursing home abuse includes:  Bed Sores / Pressure Sores; sexual assaults; slip and falls.

Sexual Abuse Cases:  Negligent hiring of employees at children’s camps, negligent supervision at daycare facilities.

Defective products:  Workplace equipment, medical products, hernia mesh, hip implants, automobiles, drugs, children’s toys.

Fatal accidents: We help family members pursue wrongful death claims following fatal accidents. Together we can help send a message that reckless and negligent actions will not be tolerated.

Civil Rights:  Excessive force cases; Section 1983; police brutality; liability through inadequate training, screening, or procedures.

Bus accidents: We handle all types of bus accident claims, including those involving city buses, charter buses and school buses.

Trucking accidents:  Operators of 18-wheelers drive the most dangerous vehicles on the road.  Because of this, when they are overworked, distracted, or not properly trained by their company, the effects can be devastating.  Accidents that involve 18-wheelers are different from car wrecks. The sheer weight and size of an 18-wheeler means passenger vehicles often bear more of the damage. Unsurprisingly, injuries suffered in 18-wheeler accidents can be serious, long-term, and costly. If you or a loved one has been injured by an 18-wheeler, call us to schedule a consultation to discuss your options.  Common reasons for accidents:

  • Driver Fatigue
  • Driver Inattention
  • Not following Federal Motor Carrier Safety Regulations

We also handle a number of other personal injury cases, including product liability claims, motorcycle accidents, auto collisions, trucking accidents, pedestrian accidents, construction accidents, environmental disasters, toxic exposure, injury from assaults or batteries, boating accidents, airline disasters, on-the-job accidents, as well as various other negligent and intentional wrongs that can occur in our day-to-day lives.

Experienced Handling Of Product Liability Claims

The term products liability refers to defective and dangerous products which cause both personal injury and property damage. Every year in the U.S. thousands of people suffer serious injury, wrongful death or serious property damage as a result of using a defective and dangerous product.

Product liability refers to a manufacturer or seller being held liable for placing a defective or dangerous product into the hands of consumers. Responsibility for a product defect that causes personal injury or wrongful death can apply to all sellers of the product in the distribution chain. This would include the product manufacturer, a manufacturer of component parts, the wholesaler or the retail store that sold the product.

Generally, a product can be defective or dangerous in one of three situations. First, there could be a manufacturing defect which resulted in the product being dangerous. Second, there might be a design flaw that causes the product to be inherently dangerous. Lastly, there may be a marketing defect, where a dangerous condition exists and is known by the manufacturer or seller which could have and should have been warned against but was not. Any one or all of these conditions could lead to serious personal injury, wrongful death, or property damage.

Common Defective Consumer Products Include:

  • Dangerous children’s toys and clothing
  • Saws and electrical tools
  • Circular saws
  • Farm equipment
  • Tractors
  • Automotive defects
  • Defective roof
  • Roof crushing / rollovers
  • Rollover protection systems
  • Skid-Steers
  • Boats and watercraft accidents
  • Medical devices, hip implants, prescription medications
  • Weight lifting equipment
  • Industrial equipment
  • Forklifts
  • ATVs, four-wheelers, and other utility vehicles (UTVs) without proper stability causing rollovers, having improper warnings, lacking doors and  seat belts causing paralysis and death
  • Cars and trucks and their component parts such as tires and seat belts, rollovers, roof crush, seat back failures, fires, gas tank explosions

If you have sustained a serious personal  injury due to a defective product, please give us a call at 512-478-2211

What are ATVs and UTVs and why are they Dangerous?

Per the ATV Safety Institute, An all-terrain vehicle (ATV) is defined as a motorized off-highway vehicle designed to travel on four low-pressure or non-pneumatic tires, having a seat designed to be straddled by the operator and handlebars for steering control. ATVs are subdivided into two types as designated by the manufacturer.

  • Type I ATVs are intended by the manufacturer for use by a single operator and no passenger.
  • Type II ATVs are intended by the manufacturer for use by an operator and a passenger, and are equipped with a designated seating position behind the operator.

Utility Terrain Vehicles, or UTVs, are built and used more for work on land rather than sport or recreation. UTVs can carry more passengers, typically 4-6.  UTVs have four wheels and handle more like a car rather than an ATV.  In the typical UTV product defect case, not only can you hold the manufacturer liable you may have a claim against the property owner of the premises where the accident to place.

These types of vehicles are extremely dangerous because they lack many of the safety features that other vehicles are required to have by state and federal laws such as doors, windows, airbags, and seat belts.  Moreover, ATVs  and UTVs have a tendency to rollover due to the terrain traveled on and lack of stability.  Because these vehicles are not required to be equipped with certain safety features, many times a manufacturer fails to warn of known dangers that these safety features would prevent.

If you or a loved one has been injured due on an ATV or other utility vehicle, call us at 512-478-2211  to schedule a consultation to discuss your options.

Dangerous Children’s Toys and Clothing

Thankfully, the federal government has many safety regulations regarding children’s toys.  Unfortunately, these regulations are not always enough to keep our children safe.  Common problems with children’s toys and clothing are:

  • Failing to warn of a known danger, such as a choking hazard
  • Allowing toys to be manufactured for the wrong age group
  • Loose buttons on clothing causing a choking hazard
  • Defective packaging that may cause harm to a young child

If you believe your child’s toy or clothing is subject to a recall you may check  online at the United States Consumer Product Safety Commission.
